Terms of Service

These terms govern your use of The Company (“the Service”), a private financial dashboard for sole traders and small companies. By creating an account you agree to them. If you do not agree, do not use the Service.
Your account
You sign in with Google, and you are responsible for keeping that Google account secure. You must be at least 18 and using the Service for a business or professional purpose. You are responsible for everything done under your account.
What the Service is, and what it is not
The Service records, organises and reports on financial information that you enter or import. It performs arithmetic on the data you give it.
It is not an accountant, a tax agent, or a financial adviser, and nothing it produces is tax, accounting, legal or financial advice. Reports, totals and financial-year summaries are a convenience, not a substitute for professional review. You are solely responsible for the accuracy and completeness of anything you file with a tax authority or provide to a third party, including where the underlying figures came from this Service.
Your data belongs to you
You retain all rights to the data you put into the Service. We claim no ownership over it. We access it only as needed to operate, secure and support the Service, and we handle it as described in the Privacy Policy.
Third-party connections
The Service can connect to third-party providers such as Stripe for payments and an email provider for sending invoices and receipts. When you supply credentials for those services, you authorise the Service to act on your behalf within them. Your use of each third-party service is also governed by that provider’s own terms, and we are not responsible for their availability, pricing, or conduct.
Payments made against your invoices flow through your own payment provider account and settle to you directly. We are not a party to those transactions and never take custody of your funds.
Acceptable use
You agree not to:
- Use the Service unlawfully, or to record or facilitate unlawful activity.
- Attempt to access another account, or any data that is not yours.
- Probe, scan or test the security of the Service except with our prior written permission.
- Interfere with the Service’s operation, including through automated load that degrades it for others.
- Resell or provide the Service to third parties without our agreement.
Availability
The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation, and we may change, suspend or discontinue any part of it. Where a change is material and within our control, we will give reasonable notice.
Keep your own records. While we take backups, you should export anything you rely on. Do not treat the Service as your only copy of records you are legally required to retain.
Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, lost profits, or loss of data, and our total aggregate liability arising from the Service is limited to the greater of the amount you paid us in the twelve months preceding the claim, or AUD 100.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited to resupplying the Service or paying the cost of resupply.
Ending your use
You can stop using the Service and request deletion of your account at any time by writing to hey@archiekerr.com. We may suspend or terminate an account that breaches these terms, and where practical we will give you an opportunity to export your data first.
Changes to these terms
We may update these terms. The date at the top of this page reflects the current version, and we will notify account holders by email before a material change takes effect. Continuing to use the Service after that point means you accept the revised terms.
Governing law
These terms are governed by the laws of Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
